I think that Goldstein is much better positioned to decide what will happen should the State decide to appeal or perhaps to pre-empt with a deal so this can be put to bed. I have no doubt they have been in touch. As for the "precedent", that was established long ago others who paid up to Kentucky. Now there is no doubt that time has passed and judgments like the one in Illinois make it much less likely that the state would prevail, yet merely the opportunity cost of having management have to go through argument again or the sitting on the sidelines of major banks who have made it clear to management that they would not invest until Kentucky was off their shoulders, is perhaps not worth the final price.
