Auxly is the one that needs to be sued by FSD

Actually seeing as it was FSD that terminated, they're going to be on the hook for breach of contract and Auxly will likely recoup most if not all of their money as a result. People are funny and just clinging to any hope they have right now, but in reality I doubt any company is going to come around and put money into FSD considering the constant delays, lack of license, failed crops, structural deficiencies, bizarre management shakeups, strange random investments, and now potentially $10m clawback hanging over their heads, considering they don't have any product, any production, and their cash flow is rapidly dwindling. Of course management and underwater investors will try to spin it as best they can, but none of these things are positive or speak of a healthy company.
