Nothing to sue, no assets in the US. Canada has specific laws regarding helms-burton that state no court actiion regarding title 3 will be recognized by a Canadian court. Sherritt is sheilded from helms-burton in this regard because it has nothing the US can seize.
Regardless, I doubt they would proceed with the full action as it would cause serious strain with many, many, allies. More bark than bite.
