Delays, delays and delaysI personally think that unless a deal is struck, we will have to wait for a long time. Judicial process usually takes a long time. Presenting a motion is something, the judicial process is another thing. Before judging, Courts will let the parties examining the other parties out of courts, filing various documents to support one's position and even let the parties file an expert reports once the experts can review the documents and the examinations of the parties. Then, based on the availability of the attorneys and the courts, a court date is given to hear the case on the merit. All the presences in courts before a trial on the merit usually serve to settle interlocutory dispute (admissibility of evidences, motion for guidance, interlocutory injunctions and so on). The process is usually long and I hope that we will not have to wait years to see some results...
This process is the same for all parties, even if you think that your contract is crystal clear. Judges usually want to make sure that all parties had the opportunity to file all their evidence in the court records before judging.
I have not looked into the court record though and I did not read the proceedings that were filed. I wish we could all have access to the documents filed in the Court record and stop this guessing game.Obviously some exceptions to the standard process might exist in any jurisdictions and I hope that the dispute involving UCU falls into one of the exceptions which would give access to an expedite process. Otherwise, what will happen to UCU if all the energies of the company are invested in a court file? And for how long can UCU wait before having some financial issues?
