However, my understanding is that the veto was inappropriate as the EPA postulated a mine plan that was not contemplated by the company and in effect set up a straw man and then vetoed on that basis. NDM can take the position that the veto has no power as it contemplates a project that was never proposed. Therefore if the Corps approve the project as presented then the EPA has no grounds to veto.
