What is Mittleman waiting for?

What is Mittleman waiting for?Any idea why they haven't called a special meeting yet?  The lawsuit shouldn't prevent it.  Every day with the current CEO and BOD in place risks a garbage transaction that can't be undone.  Only reasons I can think of, is that Mittleman doesn't yet have a slate of board nominees (which they claim they do), or they want the meeting to take place in September when shareholders are not on vacation and more likely to vote in large numbers.  The NCIB will be tapped out soon and the share price will suffer without a catalyst.  

Please let me know if I'm missing something obvious.  I've been on vacation, but kept up with the drama as best I could.
