Think it was turned down because it could not be shown that Kyrgyz held the majority share of assets of the company in question and, therefore, expropriation of such assets was deemed unduly harmful to all that particualr company’s shareholders.
However, my other questions would be do we know if Kyrgyz have informed the Stans admin’ formally that they will not pay the award? Or, are we still waiting to see if both sides are in fact negotiating, probably for a reduced award in return for early payment?
Regardless, it seems that most if not all the award will be swallowed up by funders and debts so Stans are probably leaving it all in the hands of the funders to pursue; they, in turn, probably don’t want another year(s) locked in legal action.
I doubt the REE equipment has much value. Without permits to reestablish processing, cash to rehabilitate and update and then the securing of offtakes/financing for purposeful production difficlut to see how this even begins. Maybe Kyrgyz will take the facility back in a 'fire sale' as they have control over its’ permitting and can hold it idle as long as they wish. Nor, do I think that they will find much external interest. The Russians already have Polymetal with the Tomtor and Skygrad investing in REE mining/processing within Russia. China has fingers in MP Materials, Hastings, Northern Mins and Greenland Mins etc., to facilitate they future mining needs.
Seems that the most likely avenue for Stans is via the Lithium project, but I am not sure how they could contribute out side of maybe personnel; although, any Lithium project would probably take them on as consultants rather than involving an entire cashless company.
I do hope that those who have held their shares are eventually rewarded with some price spike so they can try and get some recompense.
