I'm very surprised too. I thought Estudio Muniz would have handled better the appeal process, but it's enough seeing the Appeal for Review they presented to realize that isn't the case.
Maybe my attorney is right and this big law firms are respected more for their size and billing than for their rate of success. But I guess a foreign company will always commission a big law firm so that, even if the outcome isn't favourable, they can say "we hired the best" to their shareholders.
My experience in Peru is that attorneys don't have a sign on their back that says "I'm the best" or "I'm the worst". I think the only way to find a good attorney is by reference or by the tough process of trial and error. And the latter has been my case, before this attorney, I've worked with several other, but the time and experience has shown my that this one is by far the best, and up to date he has proven right in 100% of the situations we have had to handle.
Looking to the future, I think the best advice to the Company would be to seek advice of various attorneys, in addition to the work being done by the law firm taking charge of the case before the Judiciay. I think at this point management have already realized of the mistakes done by the law firm, so they are taking actions to correct the way. The facts and arguments are clear, all they have to do is make sure the attorneys are presenting them and in the right way!!
