This Patent seems to post date RotoGro's first US Patent lodged in 2003 and awarded in 2005 ...

This Patent and subsequent Patents do not address or cover the; stackability, modularisation, hot air removal or CO2 delivery as part of their invention as covered in RotoGro's Canadian Patent ...

Given it took the US and Canadian Patent offices four years to award the Patent from when RotoGro lodged I would say they looked at all other Patents and assessed the merits of the RotoGro Patent in light of all existing Patents ... 

I don't think we should bury our heads in the sand here and we should get a resolution soonest so we can carry on our business and move to profitability ...
