Unfortunately, it sounds like the plaintiffs will never actually get to collect anything from the anonymous defendants.  I'm a little surprised that the new articles don't make any direct reference to the obvious question in my mind: why weren't the Internet Service Providers (ISPs) compelled to disclose the identities of the guilty parties associated with the respective anonymous email addresses.  I am assuming that this cannot be done because the offences are not actually criminal in nature, in which case subpoenas could have been issued to the ISPs for that purpose.  Are there any lawyers out there who can confirm if my assumption is correct?
