Thats a very big IF.  Firstly, patentees win 60-65% of the time in Canada.  Secondly, for a counter claim, you would need to prove that the evidence that wasn’t factual or misrepresented in some way or was part of a smear campaign.   Winning a case does not automatically mean you will win a counter claim.
