Oh trust me, that is at the top of the list.
1.  Is there in fact a 3rd party?
2.  If so, is management communicating to them that they have shareholders to answer to and need to be updated as a PUBLIC company?  Do I need to highlight PUBLIC.
3.  What is the company doing in terms of marketting to get the word out?
4.  What exact has been going on and why are you not updating shareholders?
5.  Anything else?

Question for a lawyer:
1.  What are the rules surrounding public disclosure?
2.  Can a public company legally enter into a NDA without disclosing to the public that they have?
