I have no direct knowledge of the potential legal concerns between MWX and ETI, but I am interested in what exactly was provided to Iberian/Mineworx when Enviroleach was spun off. I recalled that Iberian/MWX was given the rights to use the formula under particular constraints, so I went back to the press release of the spin off:

Although that is not a legal document, the PR says that ETI will receive all X-Leach related assets and IP rights for a price of $3M. It also says the following:
"Iberian's wholly owned subsidiary, Mineworx Technologies Inc. will receive a free sub-license to use the technology in its business operations, providing it is not in competition with EnviroLeach.".
Perhaps that is where the disagreement lies... There is quite a bit to interpret in that passage and likely a lengthy legal document behind it.
