You missed my underlying concern.  If Delta 9 all of a sudden goes hogwild buying up DN under the NCIB at prices higher than this insider's buy price...then I have a little ethical problem with that.  Wouldn't that be some form of front-running?  At the expense of fellow shareholders?  If the CEO thinks the SP is a deal, doesn't his fiduciary duty to shareholders call him let the company buy back shares first?  I'm not a lawyer but I'm pretty sure there are rules surrounding this potential coarse of events, and if not the optics would look horrible.  Just saying...
