State Agency Supports Decision to Deny Back Forty Permit
The Michigan Dept. of Environment, Great Lakes, and Energy (EGLE) agrees with the decision of Administrative Law Judge Daniel L. Pulter to deny a "wetland" permit for the proposed Back Forty mine in Menominee County, Michigan, according to a published report.
The agency sided with the mine developer, Aquila Resources Inc., when then-director Heidi Grether issued the permit over objections of her own staff. However, a spokesman for the agency now says Judge Pulter was right to invalidate the permit.
This signals that the agency may not defend the permit if there is further litigation.
