RE:Vern Yu Letteryouknow I read the letter. IMO, ENB's weak point in their arguments remains III. Claims re Curvature. Unlike other sections of the letter, ENB does not openly refute the existence of violations of bend radius, which is disappointing. It thus appears highly likely that the pipeline fails to meet this criterion of the easement. What possible actions ENB can take to correct it is unknown. I suspect there are in fact none that are technically and financially viable, except complete replacement of the existing line with the tunnel project. All other rebuttals to the claims in the state's notice to ENB appear bulletproof.
