And yes, Bechtel is ultimately liable as it managed engineering, procurement, and construction of the line. That said, if the line is not in compliance with the easement terms and conditions (I strongly suspect it is not), and ENB cannot rectify the problem (which I believe it cannot, except to build the tunnel replacement), it appears that MI is well within its right to terminate the easement, unless there is proof (which I highly doubt) that government officials were aware of the violation and accepted kickbacks to ignore it, in which case the state shares responsibility for the non-conformance. I believe that ENB will position this case to point to the tunnel project as the fix to achieve compliance, and the state will (hopefully) be forced by the courts to accept this action to resolve the issue.
