The sales would not be in the USA or Canada.

The lawsuit is claiming that the company mislead investors and does not have the expertise in Diagonostics microbiology.

Fact is SONA did not have the expertise to get US FDA or HC approval. They relied on third parties for much of their work. Whether that was in the disclaimers early enough is a grey area.
