Thought naked shorting was outlawed. So if the short seller can't deliver the shares he can still hit the sell button regardless but if a broker can't deliver shares to a retail investor to buy then they shut down the brokerage or limit? When has there ever been a severe shortage of shares to sell when market has momentum?

Nope  they don't bust the borkerage very often, might wack the traders pp and say bad boy, but seriously brokerage have traders and compliance officers, a good trader knows how to push the boundrys and the compliance officer keeps them in check watching all trades, If the shares cannot be found to be borrowed a buy order is issued no matter what the price to cover is, this is how it is supposed to work. now there are fails to deliver and believe it or not there is a form you can fill out and literally say the dog ate them and then it goes to a special account until who knows when. then you factor in the 3 day settlement period and you have the open door for short attacks where a shorter gets 3 days to come up with the shares but by then the damage is usually done. thats the naked part. dig into it the rabbit hole is deep
