Apollon and HPQ do not currently have an exacting valuation of their agreement, in dollars, and therefore it makes the most sense to touch up on it regularly, just in case one company feels they are missing out on something. Apollon is not a competitor, they are a friend, much like Pyrogenesis is a friend, and there is no need to worry about one walking away from the other.
As for the 1/3 ownership thing, I highly doubt that is in the plans. Pyrogenesis has set itself up to have 50% ownership of HPQ Nano down the road, and I do not think they are in a position of need, or desire to lose any part of that ownership.
Now, should HPQ Silicon be taken over, or taken out(highly unlikely), the structure of the HPQ Nano deal has made it virtually impossible for Pyrogenesis to lose control over the Nano-silicon process made possible through Purevap, which in turn makes it easier for them to obtain other partners for other reasons and not risk being raided for that technology and it's rights.
