Smith & Nephew v. Anthrax @ SCOTUSThe SCOTUS heard oral arguments today on this case. The court is being asked to consider the constitutionality of APJs at the PTAB. The argment is that if the APJs are unconsitutionally appointed, then their decision are invalid and require to be set aside and re-reviewed.
There are about 750 PTAB decisions affected and Polaris has a dog in the fight.
It's also interesting that Jeffery Lamken (Wilan's appellant lawyer in the Apple case) argued for the appellant, Anthrax.
