If the patents were tested at lab or small pilot plant it would already been announced. Companies like Freeport don't sign with unproven tech. Has any of the patents been implemented and produced anything?

Assuming a lab, SCY will need to scale this up to a pilot plant. If it was a pilot plant, then it will need to scale it up to as part of the commercial production. Who knows what stage this is at?
Its true that these patents need to be proven economically viable and depending on where they are in the process more time (and money) may be needed.
If anyone were to uses a patented method they would be liable. Granted, SCY doesn't have the financial resources to legally fight a patent violation but it hopefully will not come to that.
Its funny that its "common knowledge" that they are in talk with Freeport when the company has not disclosed anything. This is truly a speculative story. :)
