Primary Symbol: PHO

The investment seeks to track the investment results (before fees and expenses) of the NASDAQ OMX US Water IndexSM (the underlying index). The fund generally will invest at least 90% of its total assets in the securities that comprise the underlying index. The underlying index seeks to track the performance of companies that create products designed to conserve and purify water for homes, businesses and industries. The underlying index may include common stocks, ordinary shares, American depositary receipts (ADRs), shares of beneficial interest and tracking stocks. The fund is non-diversified.

I was only talking about the other companies fate, when I said we replaced the CEO and BOD.  That is not the case here.  In the other example the company owned a large and valuable ore body, but the leadership was driving the company share value into bankruptcy territory.  In that case investors had watched for years while the leadership did as little as possible.

PHO has a purchase offer on the table, which is very different from the situation I was describing.  

Sorry for the confusion.  All we need to do is organise a 34% NO vote.  Your approach to the order of things is quite correct.  I just don't want to get to the finish line, short of NO votes.
