One of the projects is being sued by environmental folks for not having their permits before some excavation.  There is no serious construction going on at the two projects.  

The AJL at the PREB has wide sweeping powers.  PREPA is claiming that the PREB has no power and that is the key issue before the AJL right now.  PREPA is refusing to answer to the facts and instead making this a jurisdictional issue.  If, and its a BIG if, if the AJL abdicated its authority the PREB would have major legislative and constitutional issues as the PREB has sole discretion on these matters.  If they punt, they would lose all their power, which no agency wants to do.  Its all politics right now.  The easy thing to do would be for PREB to accept us as the 3rd project. That would cover for everyone including the FOMB which cannot override regulatory or judicial orders and the PREB is the sole and primary regulatory agency for electrical generation.
