Re:
OU-7 Draft BHHRA-SLERA Report
-NDEP Collated Comments and Direction to ARC
Anaconda Copper Mine Site
Lyon County, Nevada
Dear Nick,
On March 5, 2021, the Atlantic Richfield Company (ARC) submitted the Draft Baseline Human Health
and Screening Level Ecological Risk Report (Report) for the Wabuska Drain (OU-7) to the Nevada
Division of Environmental Protection (NDEP) for review and comments. NDEP is providing an attached
set of collated comments and direction to ARC. The collated comments are a result of comments
developed by NDEP, NDEP’s technical support contractor, the Bureau of Land Management, US EPA
and the Yerington Paiute Tribe. The comments and direction are focused so ARC can revise and finalize
the OU-7 BHHRA-SLERA Report accordingly.
The NDEP hereby directs ARC to make the required revisions, incorporate the recommended changes,
address the NDEP collated general and specific comments, and provide a Final Report to NDEP by July
26, 2021. ARC is also required to submit a Response to Comments (RTC) Table as an appendix to the
Final OU-7 BHHRA-SLERA Report that specifically details where and how each comment and direction
are addressed in the Final Report. ARC will notify NDEP if clarification is needed, or if additional time is
required to finalize the Report.
If you have any questions related to the content of this letter, or the attached collated comments and
direction, please contact the undersigned at 775-687-9484.
Sincerely,
Jeryl R. Gardner, P.E., C.E.M.
