Just a little background. The Michigan statute that is relevant to Aquila's Back Forty project (Part 632 of the state's Natural Resources and Environmental Protection Act) was passed in 2004 after extensive negotiations with stakeholders including environmental groups and the mining industry. Tom Casperson, then a state representative, took the lead in getting everyone together and reaching a compromise. I see absolutely no prospect that the Michigan legislature will to revisit the matter. Too difficult, time-consuming and risky (once you re-engage, you can't be sure you'll like the outcome).
