RE:RE:DSM needs to clean houseYep
That was some dumb stuff in the statement.
"No Breach of Contract'  because the gov was appraised of the breach and did not object lol!  Sound to me like someone needs to go back to law school!   That is like saying I bought a car for 10k and paid 2k up front and promised to pay 8k in 4 weeks.  So after 2 weeks I inform you that I am only going to pay 4k because you were in shock and did not immediately object by default you agreed.  Or like a judge letting you off on probation for 2 year as long as you stay out of trouble.  So you send the court a notice saying you think you are going to get in trouble and they do not reply.  You then go and carjack someone and you say you did not breach your probation because you informed them and they were aware you were going to breach!  Definately a stupid statement.  A breach is still a breach of a contract whether you inform someone you are going to breach.   The company may have informed the gov of the proposed breach but unless they agreed in writing somewhere it is still a breach.

The gov is probably glad they breached maybe they can get better terms now that a pile of money has been spent?? Just one mans guess!
