There is nothing to "take" because the deposit is currently an unproven economic resource.  The federal government has taken nothing.  The door remains open for 404 permit resubmittal.   Why didn't they just apply for underground mining the east zone?  Odd.

The system of mineral claiming on State land should be revised to include specific exploration, economic analysis, development, construction and operating milestones. Not just paying the claim fee and doing minimumal qualifying work to maintain.
