If Thomvest is blocking access to these witnesses, it is clearly an admission of guilt that something oppressive to majority shareholders at the time had happened. Management by late 2018 knew that Thomvest owned their big debt and could apply a lot of pressure in the direction that they wanted things to go. Else, they could have considered a rights offering for financing which some major shareholders had suggested at the time.
