It can't be too low.  

As WiLan would run the risk that if the CAFC sent it back for retrial (very unlikely) a low settlement would be used against WiLan on the Apple retrial.  

A low settlement agreement MUST include Apple because of that fact.  

Let's see if there is a settlement right before the court hearing.  Those have happened in the past.
