Practically this will be the final decision. The losing party can request an en banc hearing (all the judges) but thus us not often granted. The lising party can also appeal to the Supreme Court, but a case like this would rarely be considered by the court. There is an outside chance that the CAFC send the case back to the district court. However, the CAFC judges opening comment was, "Why can't you guys just settle?" Those are the possible outcomes/further steps. But, as I said, the CAFC decision will be the final decision for all practical purposes.
