RE:Interesting what could this mean for patents ? Good catch SPP. This is a very complex matter, or is it? 

Positive way of looking at things
  • CO2 extraction is the old method that Nextleaf replaced and superceded. Companies like LABS are slowly dying using it. So not clear what the point of the litigation is, besides collecting infringement compensations from a vast number of companies ($$).
  • Indeed this could be the end of CO2 extraction leaving an open field to Nextleaf IP. Then, maybe, Nextleaf could be the object of a bidding war ($$$$).
  • At the minimum, it is: a) very good news that cannabis IP can hold its day in court, and b) that this day be a wining day.
  • It would certainly be bad for Nextleaf if the court opinion had gone the other way (though matter are still being debated).
  • The outcome could help explain why OILS was up Friday, against the general trend.
Not so positive way of looking at things
  • This litigation could keep on going for years or lead to a confidential unconclusive settlement.
  • A positive outcome in the US could have limited consequences in Canada.
  • Worse, it may lead in a twisted way someone with deep pockets to contest Nextleaf IP in search of a lucrative out of court settlement.
