         Not being served yet isn't that unusual. Patent infringement appears to be a complex field of litigation. It looks like 1-3 years to get a case to trial is common, and after that, potentially years for a judgement. Then you have the possibility of appeals. Also, the patents can similar in nature, and still be defensible in litigation. It's basically the idea or defence of the "building a better mousetrap".

So while ePropelled has planted a seed of doubt, in my admittedly inexperience judgement, it's reasonable to expect that it's going to take a long time, and a judgement could swing either way.
