Firstly, it’s highly unlikely that the Biden administration would’ve taken credit for the project if they believed that the ruling would not go in favor of the BLM and Lithium Americas. The exact wording of the press release is, “The Biden Administration has funded two dozen teams to expand sourcing of lithium from geothermal brines and approved a permit for the Nevada-based Thacker Pass lithium mine.” Again, the current administration would likely work to distance itself from Thacker Pass if it looked like it wasn’t going to go their way. The fact that the ROD was actually issued at the tail-end of the Trump administration means that it would be pretty easy for Biden to flip Thacker Pass as a failure of the previous administration. Claiming it as one of his administration’s victories this early on is, therefore, a positive sign in my eyes."
