1. The key point you didn't refute is that WiLan is burning 1.8M a month and they have virtually nothing to show for it in the last 5 months. Just losses and legal bills.
2. Litigation pipeline is what matters to earn an outsized return for shareholders. The small settlements done outside of court basically pay for the WiLan salaries as well as legal bills. The ACTUAL return to shareholders that ultimately comes through is via the large wins. WiLan has never won a single large case at a US court. There has never been a VirnetX sized win. That is why WiLan is worthless as a contribution to shareholders. It just pays the salaries of existing employees.
3. The loss of a case and award to Vizio and Sharp are very significant as it highlights the quality of the WiLan portfolio. As well as all of the other recent losses. They had to reach into litigations on patents with less certainty and this raises questions on the value of the WiLan portfolio. It is very relevant. And their lack of pursuing additional litigations is quite telling. They would rather pass the problem (oops, I mean opportunity) to someone else.
4. The fact that Todd asked this question in this way is incredible. You never hear an analyst ask such a pointed question in that tone to a management team. What else is John going to say? "Yeah, we really screwed this up and think someone else can do a better job with it. I mean, we haven't even collected on a court victory in 10 years!"
