Cabbie, good to see you emerged from your Google forum war bunker!

Everyone knows Jury trials are a coin toss.  Apples damages theory could be accepted by a new jury.  The original loss to Apple on the wifi patents were because just one jury member (the foreman) convinced everyone that Apple didn't infringe.  All it takes is one jury member.  

A coin toss is a 50/50 probability.
