RE:RE:RE:RE:RE:RE:RE:Water SourceFor your future records I have copied the actual water licence for the bottling facility below. I have highlighted the actual amount of water they are allowed to extract from the well on a daily and yearly basis.
I'm assuming they have applied for their updated permit which had to be done by March 1st 2022. This application cannot be increased from the present limits it is merely a requirement. I'll attach a link for that info.
CONDITIONAL WATER LICENCE
The owners of the land to which this licence is appurtenant are hereby authorized to divert and use water as follows: |
a) | The aquifer on which the rights are granted is Aquifer 809. |
b) | The point of well diversion is located as shown on the attached plan. |
c) | The date from which this licence shall have precedence is June 3, 2005. |
d) | The purpose for which this licence is issued is fresh water bottling. |
e) | The maximum quantity of water which may be diverted is 3,120 cubic metres per year provided the maximum daily diversion does not exceed 8.5 cubic metres. |
f) | The period of the year during which the water may be used is January 1 to December 31. |
g) | The land upon which the water is to be used and to which this licence is appurtenant is DISTRICT LOT 346 SIMILKAMEEN DIVISION YALE DISTRICT EXCEPT PLANS H17963 AND KAP89411. |
h) | The authorized works are treatment facility/system, pipe, pump, pumphouse, flow measuring device, and the well associated with WTN 113928 which shall be located approximately as shown on the attached plan. |
i) | The construction of the said works has been completed and the water is being beneficially used. The licensee shall continue to make regular beneficial use of the water in a manner authorized herein. |
j) | The licensee shall install a flow measuring device to the satisfaction of an Engineer under the Water Sustainability Act. |
k) | The licensee shall retain flow meter records for inspection upon request by an Engineer under the Water Sustainability Act. |
l) | The works authorized under clause (h) hereof shall be maintained to the satisfaction of an Engineer under the Water Sustainability Act. |
m) | This licence is issued under the Water Sustainability Act (the Act). The exercise of rights under the licence is subject to the Act and its regulations, the terms and conditions of the licence, orders under the Act and the rights of licensees whose rights have precedence on the stream or on an aquifer. The licensee must comply with all such requirements, as well as the provisions of all other applicable enactments. In exercising rights under the licence, the licensee must exercise reasonable care to avoid damaging land, works, trees or other property, and must make full compensation to the owners for damage or loss resulting from construction, maintenance, use, operation or failure of the works. |
n) | During all phases of construction and maintenance of the licenced works and related activities, the holder of this licence is subject to the habitat protection requirements described in the document entitled “Terms and Conditions for Construction and Maintenance of Licensed Works” (dated March 1, 2017). Those habitat protection requirements are hereby incorporated into this licence as if written herein as licence conditions, which requirements must be implemented by the licensee in conjunction with any guidance provided by a Water Manager or Habitat Officer. |
