Based on past performance they should currently be $3M in the hole. (this doesn't include the money involved in the lawsuit)

Six months ago was the last financial statement in which they $3.1M in assets and $11.5M in liabilities with a burn rate of $3M per quarter (they are far beyond currently cashless) That happened last quarter.
