I think the idea that CEZ can't disclose the terms of their annual contract negotiations, to shareholders, is very problematic legally if it was ever challenged in court (the secrecy of course gives the seemingly inept independent board members cover).  Glencore argues revealing it would affect their competitiveness which is an incredibly dubious claim.  This is particularly true given anyone with even a basic knowledge of accounting can retroactively figure out the terms which appear to be the same every year. I think in discovery during a tort case they would also  have to reveal the terms of the SPA.  The real issue is who wants to go to expensive of civil litigation against someone with deep pockets.   I agree if Extract took their investment seriously, they would have asked for a board seat as generally over 10 percent ownership is enough to obtain one.
