The Water Supply agreement with Sage Ranch is from the City to Sage Ranch not the Water District. (which under law and its own City Regulations must supply Sage for 20 years) The City holds a water utility license and is the sole supplier of water to any customer within the City Limits. The City has its own wells, its own infrastructure and owns and leases its own deeded rights. It is the water provider under CEQA, not the District.

The 10 year agreement you refer to is between the City and the District and in that 10 year period (the period ends under 10 year advanced notice) commenced already, BUT expires under a 10 year notice. Since all utilities and water districts work under a forecast, the water district owes the the City 11,070 AF during any ten year period. That's more than compensates the City's legal requirement for the 3,500 AF we did not have to provided under deeded rights.  (But we have them anyway)

The fight between the District and the City is under the beef the district has in hating the agreement they have to provide the City that 1,107 per year or 11,070 over 10 years. All deals positive and negative get banked.  The district is not the water provider to Sage. It has an obligation under contract to the City. The City can increase its production if the district upsurps its adjudicated mandate.

Regarding the indemnity we signed with the City, we have had the top two legal firms in the US confirm ( and the City knows this) that the indemnity does include defective work by the City or negilence. If the City made a defective or negligent water report the City must correct it.  If the indemnity covered negligent or defective reports, the City would not have objected to the Districts lawsuit against the City. It would simply unoppose and let the district not allocate water under contract to the City. (which the district is under breach) 

Your still not understanding the legal relations between the two entities and CEQA itself, nor the politics. 

But you are trying hard to make an arbitrage play between PWR and GRB and you will fail at that as well as the timing or back issues are not in your control.  Even Blizzy420 said under his old post, you were trying to time the deal of PWR and GRB.  Sorry, you are in the back of a 11 year bus moving to a new and better neighborhood.
