Ruling on the document dated May 18, 2022, submitted in the Virtual Judicial Office by the plaintiff’s attorney in Folio 189.
To the principal: Note that the plaintiff’s list of witnesses is presented, cited. To the first addendum: As requested, to the international exhort, with respect of the witnesses identified in Nos. 2, 3 and 4 of the preceding list, the rogatory letter will be sent to the competent court in Toronto, Canada, for the purposes of notification and conducting the testimony of the witness John Thornton…; with respect to the points Nos. 1, 2, 3 and 4 contained in the interlocutory evidence issued on October 14, 2020; and also, the Court of Vancouver, Canada, for the purposes of notification and conducting the testimony of the witnesses Peter Brady … and Roy Leon … in order to refer to points Nos. 1, 2, 3 and 4 in the interlocutory of evidence issued on October 2020, the following powers are delegated to the International Tribunal exhorted: a) Notify the witnesses referred to above; b) Receive new addresses within its jurisdictional territory; c) Receive documents to notify and delegations of power; d) Set the day, time and modality for the testimony of the witnesses referred to above; and e) In general, all the steps to fully comply with the order. To the second addendum: As requested, an extraordinary period of evidence is set for the testimony of the witnesses referred to above, in accordance with the provisions of Article 329 of the Code of Civil Procedure for a period of 20 working days. To the third addendum: Please accompany the documents with a summons. To the fourth addendum: For the receipt of testimonial evidence that will be rendered within the jurisdictional territory, and in accordance with the agenda of the Court, a special evidentiary term is set for reception of evidence from the third parties, on Tuesday, October 11, 2022 at 9:00 a.m.
The witnesses and the judicial receiver must attend in person at the premises of the Court, the latter required to attend with all the technological means necessary for the development of the same. The others, interveners, will attend remotely.
