Document exhibition and appt of expertThere have so many documents lately that I am falling behind in my translation. Instead of giving you a translation, here is a summary of two related documents.
C 1036-2021
The lawyers for Claro & Co. requested a document exhibition from JL.
“Since this affidavit refers to the state and nature of a series of contentious trials and non-contentious proceedings brought before the national courts of justice, the exhibition of certain pieces of such files will allow this Court to give a correct resolution to the present case. In particular, the examination of the documents whose exhibition is requested will allow this Court to conclude that (i) the affidavit of Mr. Felipe Ossa did not incur the alleged falsehoods, (ii) the conclusions that my client delivered to the BCSC were faithful to the state and nature of each of those procedures at the date of the affidavit was issued (May 31, 2017) and (iii) the affidavit does not require a special qualification in mining law to be issued, but the proper qualification of an attorney admitted in Chile with experience in judicial proceedings before Chilean courts.”
The documents requested are all the judgments and certifications of enforcement on all judicial proceedings relating to Amarillo Norte claims; Amarillo Sur claims; Cristobal’s lawsuit C 719-2011 and its appeals; JL’s lawsuit to nullify the Los Amarillos concessions C 560-2012 and its appeals; the Villar Lawsuit and its appeals; and the Option Agreement with any modifications and/or terminations.
The Court set the date for the document exhibition on Wednesday, September 6, 2022 at 9:45 a.m.
Also, in the same resolution, the Court set the date for designation of an expert (this expert is for the psychology testimony relating to the mental and emotional distress suffered by JL) at 9:30 a.m. on Wednesday, September 6, 2022
