According to the Chilean Mining Code,the owner of record of the application to mine first submitted or filed shall be presumed to be the discoverer. However, no special rights are granted to the discoverer in the mining code. "The claim first filed will be preferred for the creation or establishment of a mining concession." However, Villar gave up his place in line when he sold the claims before they became concessions. Then CMN let them lapse, so no more perference.

Correct. C 1912-2001 was found in favor of CMN. The Amarillos Sur and Norte claims were not returned to Villar.
2. JL was not a part of C 1912-2001. He later joined on Appeal.
3. The 2006 verdict was overturned on appeal. Barrick filed the appeal 2375-2002. It was decided on 10/01/2007 - rolling back the trial to before the parties were called to hear the verdict. Villar did appeal to the Supreme Court, case 5374-2007, which was subsequently voided by the Supreme Court.
4. There is no divine right and JL gave up any rights he had when the properties were sold. No one has rights to a property once they sell it.
5 JL has different rules for himself than he does for other people. He says it doesn't matter if he has titles or not, but demands to see Barrick's titles.
6. According to JL, nothing is his fault. He blames anyone and everyone other than himself. As a laywoman, I would say that he has a narcissistic personality disorder. He sees himself as being superior to others and doesn't mind stepping on them to achieve his ends because only he and what he wants is important. He gets very angry and is insulted when he is told no. JMO.
7. If JL had any friends left, they would have taken away his shovel because the hole he dug is already deep enough.
I don't think the ruling at the end of this trial and the identical trial filed by MSX are in doubt. JL seems to think his bluster and accusations of fraud will be enough to win the case, but courts prefer actual facts and evidence. The verdict in the BC Appeals case will be much more interesting. I'm unsure of how soon the ruling will be issued after the hearing on September 29th. I am eager to read that ruling.
And I am not sure how JL will explain it, other than his default position that everyone one is against him and they committed criminal acts.
