I was a shareholder of high river gold as that take over was done.At that time the threshold that the aquiror had to get to was I believe 90% before they could force the minority to sell.It took them a long time to aquire the 90%.During that time the share price went from very low to a final purchase of shares at 1.40.As long as the minority refuses to sell that 90% is not as easy to attain.Thats unless the securities act has not changed.
The majority of the minority would have to agree to a sale if it's done by plan of arrangement. I think the 90% comes in play if they go by tender. I know owners of about 20m+ shares including myself and we wouldn't take a cash offer anywhere close to here and that's a pretty big chunk of the minority that would vote. There is too much earnings power and optionality.
