Pentwater has a separate action going in NY. They can take 'the same' as other dissenters on the dissent side and load up on the other settlement. TRQ won't even be a reporting issuer after the vote goes through.
These guys have shown their colours, the Rio view is beat up the little guy. Pentwater is in it for themselves, which may not be nice but is the way the game is played, they don't owe much in the way of legal duties to fellow minority shareholders.
They methodically ground down the market expectations for TRQ for over a decade, which suited both them and their "bad cop" the Mongolians exceptionally well as they cleaned up OT between themselves.
Average TRQ price, 2011, years before much advancement of the mill and mine, and a much more favourable CU outlook today .... $231.
'Nuff said.
