ConstitutionFederal and provincial taxation powers are set out in Sections 91 and 92 of the BNA Act of 1867. A province cannot arbitrarily choose which taxes they like and which ones they don't. Residuary powers are retained by the Federal Government, unlike the U.S., where residuary powers are ascribed to the states. Ultimately the courts would strike down provincial laws that cross the line.
