RE:RE:RE:RE:RE:RE:RE:RE:RE:I am Guessing Higher Offer - Any Guess as to New BidThank you for the reference Zinkdink.  I think one really needs a business lawyer to review it (people have to do their on due diligence) .  It seems this section of the document is about the problems of finding another entity to purchase the plant.  That is there are structural issues with the current contract that gives Glencore influence over another purchaser (read page 11 paragraph 4 for a more simple explanation).

You added " (GC)"  in your quote.   Why would they use the word "purchaser" instead of "Glencore" in the text unless this was material?   I question whether Glencore is the "purchaser" if they lose the vote regarding the takeover.  Lau and his partner, who will likely soon be on the board, are financial/business lawyers. I can't imagine they would be going through this if Glencore could essentially execute the business equivalent of a coup d'tat if they lose the vote. But again investors have to come to their own conclusions.
