Whereas I respectfully inform the Court that having accepted the position of expert psychiatrist in this case, I tried to carry out said evaluation, conducting a first online interview with Mr. Jorge Lopehandia on March 16, 2023. I concluded the following:
- It is not possible to thoroughly evaluate Mr. Lopehandia online.
- It is not possible to rule out major psychiatric pathology without face-to-face interviews, brain imaging examinations, neuropsychological evaluation, accounts of third parties who live with the person to be evaluated and ideally social evaluation.
- It is not recommended that the evaluation be carried out by a single expert but should be signed by a multidisciplinary work team.
- It would be an ethical fault for the undersigned expert to opine in this case, not having the possibility of applying an appropriate methodology to the case.
THEREFORE, I ask the Court to accept the excuses for conducting the assessment.
FIRST ADDENDUM: I request this Court to take into consideration, based on the experience and impeccable professional work of the expert, I suggest that Mr. Lopehandia be evaluated by the Legal Medical Service of Santiago, where the necessary methodology could be made to opine on the legal medical question requested.
SECOND ADDENDUM: I will return in full the payment for the evaluation received on February 27, 2023 from the account of Mr. Juan Guillermo Torres Fuentealba, in the amount of 600 thousand pesos to the same account.
