Its the ambiguity that has me questioning it all ... 
 
'securities are usually owned only for a short period of time' - a minute, hour, day, week, month? I asked my wife what she thought a short period of time in context to trading is and her response was a couple hours, my thinking is a week.
 
'the taxpayer has some knowledge of or experience in the securities markets' - how do they gauge that? I myself think I have very limited knowledge of the markets; part of the reason for being on this forum. Anyone making a trade on their own behalf would have to have some knowledge and experience.
 
'a substantial part of the taxpayer's time is spent studying the securities markets and investigating potential purchases' - again, what's substantial? I spend maybe 3-4 hours a week doing research, considering that is a very small percentage of my awake moments I would not consider it substantial.
 
It would be nice to chat with someone that has experienced these issues ... or if in the end my definitions of the above don't align with the governments ... I'll share the outcome here, lol.
