You are correct about the directors. The distribution waterfall for this will leave shareholders with about only 5% of the settlement or about 20 cents per share.
Should a negotiated settlement occur with a potential buyer, predicated on Colombia providing rock solid committment to the project, the shareholders may get more. However, it seems to me this creates a perverse incentive for the directors to want a settlement rather than a buyout. Why give up 95% of an ICSID payout to get a much smaller percentage from a buyout? So, as a shareholder, don't expect anyone to act in your best interest.
